General Terms and Conditions of Con Gusto s.r.o. for the sale of gift vouchers
1.1 These General terms and conditions (hereinafter referred to as “the GTC“) have been issued by the company Con Gusto s.r.o., incorporated in the Register of companies administered by the Regional court in Brno, part C, file 91494 (hereinafter referred to as “the Provider or the Seller“), and regulate all business relationships between the Provider and its Clients.
1.2 The Provider has been the restaurant keeper of the Táckárna in Brno and offers its Clients, as a part of its business activities, hospitality services and related services (hereinafter referred to as “the services“).
1.3 The Client is a person interested in making use of the services.
1.4 The Provider is interested in enabling its Clients to pay for the services rendered by means of a gift voucher (hereinafter referred to as “the gift voucher“).
1.5 The gift voucher is issued by the Provider in the value of 500.00 CZK; 1,000.00 CZK; 1,500.00 CZK; 2,000.00 CZK; 2,500.00 CZK; 5,000.00 CZK; and 10,000.00 CZK.
1.6. The financial amount as presented in the gift voucher must be drawn one-off, i. e. the Provider does not pay out the difference in case of a lower value of the service rendered in comparison with the gift voucher value. Nevertheless the Client is entitled to use the gift voucher to pay for the service, and to compensate to the Provider on the spot the amount exceeding the gift voucher value.
1.7 The value as presented in the gift voucher defines the value of the services including VAT.
1.8. The gift voucher is not related to a particular person only, and so it is freely transferable. At each of the Provider´s facility (Restaurant and steakhouse Monte Bú, Ristorante Piazza, Pivnice (beer bar) U Čápa, Gelateria Piazza) the gift voucher holder is considered to be a person entitled to use the gift voucher.
1.9 The Client shall order the gift voucher with the Provider solely in the electronic way, by its interest confirmation at the Provider´s portal https://www.tackarna.cz/ (hereinafter referred to as “the order“). By dispatching the order and the gift voucher price payment a contract of purchase is concluded between the Client and the Provider, and the Provider´s obligation shall arise to deliver the gift voucher to the Client.
1.10 The Provider fulfills its obligation pursuant to cl. 1.9 by dispatching the gift voucher in .pdf format to the email address as communicated by the Client´s order. The Provider obliges to deliver to the Client the gift voucher within the term of three days from the day it received the gift voucher price payment to its bank account. In case of failure to deliver the gift voucher within the established term, the Client shall be entitled to withdraw from the contract of purchase, and the Provider shall be obliged to refund the payment it received from the Client.
1.11 The Provider allows for the gift voucher payment in one of the following ways: with a credit card, and by a bank transfer. The price shall be settled in the way as chosen in the Client´s order.
1.12 The gift voucher is valid for the period of 11 months (335 days) from the date of its issuance. The validity term is stated in the gift voucher.
1.13 The Client agrees that the contract relationship shall be regulated by the Provider´s General terms and conditions, and in issues not regulated by these terms and conditions the contract relationship shall be regulated by Act No. 89/2012 Coll., Civil Code.
1.14 The complaint procedure: the Client is entitled to ask for return of the unused gift voucher within the term of 5 days from its purchase. The whole amount of the voucher value shall be reimbursed to the Client.
1.15 The Client agrees, in the meaning of Act No. 480/2004 Coll., on certain services of an information company, with sending of information of the Provider´s services and third parties´ up-to-date offers to the email address, or by SMS to the telephone contact as stated in the order. Moreover, the Client agrees with collection, storage and processing of personal data, as included in the order, by the Provider as the administrator for the purpose of the service rendering. This consent has been awarded for all data as included in the order. At the same time, the applicant is aware of its rights pursuant to par. 12 and 21 of Act No. 101/2000 Coll., on personal data protection. The same has been made familiar with all filled-in parts of the order; all data is exact and true; and it has been provided out of free will.
1.16 These GTC have been updated, and they have been in force and effect from 3 November, 2017.
I.
- These General Terms and Conditions (hereinafter referred to as the “Terms and Conditions”) govern the rights and obligations between the Customer and the Provider that arise in connection with the Customer’s participation in the Provider’s loyalty program.
- The Provider is the company Con Gusto s.r.o., ID No.: 047 02 557, with its registered office at Údolní 532/76, 602 00 Brno (hereinafter referred to as the “Provider”).
- The Customer is a natural person over the age of eighteen (18) or a legal entity (hereinafter referred to as the “Customer”).
- The loyalty program means granting rewards and other benefits under the rules of the loyalty program specified in these Terms and Conditions (hereinafter referred to as the “Loyalty Program”), which the Customer may obtain when purchasing meals of traditional Czech, Moravian, or international cuisine in the Provider’s premium restaurant network:
- Monte Bú restaurant & Steak house
- Piazza Caffè & Ristorante
- Pivnice U Čápa
- Pivnice nad Hladinkou
- Pivnice U Kohoutů
- KOREK Winebar
- Táckárna
- Divadelní restaurant Teátr
(hereinafter referred to as the “restaurant network”).
II.
- The Customer can register for the Loyalty Program on the website klient.congusto.cz/registrace.
- During registration, the Customer provides the following information according to the selected Customer type:
- Standard Customer: name, surname, email address, phone number
- Corporate Customer: company name, ID No., optionally VAT No., name and surname of the authorized person, email address, phone number
- After entering registration data, the Customer is prompted to agree to the processing of their personal data and to these Terms and Conditions. This agreement is necessary for registration and subsequent provision of benefits.
- The Customer will create a secure password during registration, which must not be shared with third parties. Passwords are stored in encrypted form.
- After registration, the Customer has access to a user account with:
- Overview of current available rewards
- Payment history
- Tax documents for completed payments
- Management of registration data, including account deletion
- Option to top up credit to a digital wallet linked to the loyalty card
- The Customer can choose between:
- Dependent account – allows the Customer to create up to 4 profiles that draw credit from the main account (e.g., family members)
- Independent account – allows multiple profiles, each with its own wallet (e.g., employees of a company)
- After creating the user account, loyalty cards are issued upon request and sent to the registered address. These cards can be used in the restaurant network.
- Upon delivery, the Customer must check the card package for damage. If the shipment is damaged, the Customer must refuse it and inform the Provider immediately.
- The loyalty card is non-transferable. In case of redemption of benefits, restaurant staff may ask for identification to prevent misuse.
- The user account allows top-ups to the digital wallet, max CZK 10,000, using VISA or Mastercard. The payment gateway is provided by GOPAY s.r.o.
- The Customer can save one card for recurring payments, stored only by the bank.
III.
- Payments made using the loyalty card in restaurants, the e-shop jimebrno.cz, for gift vouchers or tickets to events, will earn CG points (1 CG point = 1 CZK) as cashback according to the tariff.
- CG points are credited within 24 hours and expire in 1 year. They can be used for:
- Meals in restaurants
- Food in the e-shop
- Gift vouchers, merchandise, or tickets at www.congusto.cz
- Up to 100% of a purchase can be covered by CG points. Use of points must be announced to staff before payment.
- Points are not credited or will be deducted in case of non-payment or withdrawal from purchase agreements.
- Customers are placed into one of the following tariffs:
- Silver
- Gold
- Platinum
- Benefits of all tariffs include:
- Cashback
- Discount vouchers and offers
- Birthday surprise
- QR code for mobile app use
- Conversion of CG points to vouchers and vice versa
- Redemption at any restaurant in the network
- Silver Card: free upon registration
- 5% cashback
- Other common benefits
- Gold Card: for annual spending over CZK 35,000
- 10% cashback
- If the annual limit is not met, downgrade to Silver
- Platinum Card: purchasable for CZK 9,990/year
- 20% cashback
- Home sommelier course
- Priority restaurant reservations
- Priority access to events
- Free delivery from jimebrno.cz
- To receive birthday benefits, the Customer must fill in their date of birth in the user account. Applies also to profiles.
- Benefits are non-transferable and valid only for the registered Customer.
IV.
- Registration also grants access to the Provider’s restaurant Wi-Fi network, without the need for additional login.
- All conditions for using the wireless network are governed by a separate document (Internet Usage Terms).
- The Provider may limit or terminate participation in the Loyalty Program in case of rule violations or legal issues.
- Participation is free, except for the Platinum card fee. The Customer can cancel their account at any time, which also cancels participation and voids all unused rewards without refund.
- The Provider may amend these Terms. Changes are communicated at least 15 days in advance via email. Continued use implies consent.
- Data protection information is available at www.congusto.cz/gdpr
- The Provider may send commercial messages to the Customer’s registered email.
V. Final Provisions
- The loyalty card remains the property of the Provider. The Provider may request its return upon termination of participation.
- In addition to these Terms, rights and obligations are also governed by:
- Terms for internet access
- Terms for the e-shop www.jimebrno.cz
- Terms for the e-shop www.congusto.cz
- If any provision of these Terms becomes invalid, it does not affect the validity of the remaining provisions.
- Matters not regulated by these Terms are governed by Czech law.
These Terms are effective from 18 June 2025.
